> These Terms of Use (the “Terms”) govern the use of the WMES online platform operated by ENTAMA s.r.o. (the “Operator”). By using the WMES platform, you agree to be bound by these Terms.

# WMES PLATFORM – TERMS OF USE

### 1. The WMES Platform

WMES is a technological platform that enables users to upload digital content and grant third parties paid access to such content.

The Operator does **not** provide, verify, or control user-generated content. All content available through the platform is provided exclusively by users.

### 2. User Roles

* **Uploading User**: uploads content, sets the access price, and is solely responsible for the legality and rights related to the content.
* **Accessing User**: pays for and receives one-time or time-limited access to content.

### 3. Payments

All payments are processed via **Stripe**.

Payments are automatically divided between:

* the Uploading User,
* Stripe (processing fees), and
* the Operator (platform fee).

The Operator receives only its fee and is not responsible for payment processing, delays, or actions taken by Stripe.

### 4. Taxes

Each user is solely responsible for their own tax obligations arising from income or payments made through the WMES platform.

### 5. Content and Responsibility

Users retain ownership of their content.

By uploading content, users grant the Operator a non-exclusive license to store and technically process the content solely for the operation of the platform.

Users represent that they have all necessary rights to the content and that the content does not violate any laws or third-party rights.

The Operator bears no responsibility for user-uploaded content.

### 6. Availability

The WMES platform is provided **“as is”** and **“as available.”**

The Operator does not guarantee uninterrupted availability and may modify or suspend the service at any time.

### 7. Refunds

Due to the nature of digital content and immediate access after payment, refunds are not provided, except in cases of demonstrable technical failure of the platform.

### 8. Termination

The Operator may restrict or terminate access to the platform in the event of a breach of these Terms.

### 9. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the courts of the Czech Republic.
